eBay Loses Two Legal Battles Against Amazon

An arbitration panel handed Amazon a major legal victory against online marketplace competitor eBay over allegations of seller poaching activities.

eBay filed a lawsuit in 2018 in Santa Clara County court against Amazon and another lawsuit in 2019 in the United States District Court for the Northern District of California against three managers working at Amazon.

In short, eBay alleged that Amazon and the named employees engaged in racketeering activities that poached high-value sellers from the marketplace.

The courts ordered arbitration in these two cases hearings concluding in September 2020.

On November 10, 2020, the arbitration panel issued its final award in favor of Amazon and, “…concluded that eBay proved the element of breach with respect to five respondents (not including Amazon.com, Inc.), the Panel found that eBay did not prove that it suffered damages as a result. The Final Award denied all of eBay’s claims as to all respondents and deemed the respondents the prevailing parties in the arbitration.”

Effectively, this concludes the two lawsuits and Amazon plans to confirm the final arbitration award with both courts.
